Introduction
This Statement sets out how AI Solution Technologies Pty Ltd (“AI Solution Technologies”, “we”, “us” or “our”) complies with each of the thirteen Australian Privacy Principles (“APPs”) contained in Schedule 1 to the Privacy Act 1988 (Cth). It supplements our Privacy Policy and should be read together with it.
APP 1 Open and transparent management of personal information
We manage personal information in an open and transparent way. We maintain a clearly expressed, up-to-date Privacy Policy that is available free of charge on our website, and we implement practices, procedures and systems to ensure compliance with the APPs and to deal with enquiries and complaints.
APP 2 Anonymity and pseudonymity
Where lawful and practicable, we give individuals the option of dealing with us anonymously or by using a pseudonym. In many cases, however, we cannot provide our services or respond to enquiries effectively without identifying information.
APP 3 Collection of solicited personal information
We only collect personal information that is reasonably necessary for our functions or activities. We collect sensitive information only with consent (or as otherwise permitted by law) and where it is reasonably necessary. We collect personal information by lawful and fair means, and generally directly from the individual.
APP 4 Dealing with unsolicited personal information
If we receive personal information we did not solicit, we determine whether we could have collected it under APP 3. If not, and the information is not contained in a Commonwealth record, we destroy or de-identify it as soon as practicable, where lawful and reasonable to do so.
APP 5 Notification of the collection of personal information
At or before the time we collect personal information (or as soon as practicable afterwards), we take reasonable steps to notify individuals of relevant matters, including our identity and contact details, the purposes of collection, the consequences if information is not provided, the types of third parties to whom we may disclose the information, and how to access, correct or complain about the handling of their information.
APP 6 Use or disclosure of personal information
We use or disclose personal information only for the primary purpose for which it was collected, for a related secondary purpose the individual would reasonably expect, or where the individual has consented or another exception under the Privacy Act applies.
APP 7 Direct marketing
We use personal information for direct marketing only where permitted under the Privacy Act and the Spam Act 2003 (Cth). We provide a simple means to opt out of marketing communications, and we honour opt-out requests promptly.
APP 8 Cross-border disclosure of personal information
Before disclosing personal information to an overseas recipient, we take reasonable steps to ensure the recipient does not breach the APPs in relation to that information, unless an exception applies (for example, informed consent). We use reputable cloud and technology providers and apply contractual and technical safeguards.
APP 10 Quality of personal information
We take reasonable steps to ensure the personal information we collect is accurate, up to date and complete, and that information we use or disclose is accurate, up to date, complete and relevant, having regard to the purpose of the use or disclosure.
APP 11 Security of personal information
We take reasonable steps to protect personal information from misuse, interference and loss, and from unauthorised access, modification or disclosure, through technical, physical and organisational controls aligned with ISO/IEC 27001 and ISO/IEC 42001. We take reasonable steps to destroy or de-identify personal information that we no longer need for any permitted purpose.
APP 12 Access to personal information
On request, we give individuals access to the personal information we hold about them, subject to the exceptions permitted under the Privacy Act. We respond within a reasonable period and generally without charge (any charge will not be excessive). Where we refuse access, we provide written reasons and information about how to complain.
APP 13 Correction of personal information
We take reasonable steps to correct personal information to ensure it is accurate, up to date, complete, relevant and not misleading, either on our own initiative or on request. Where we refuse to correct information, we provide written reasons and, if requested, take reasonable steps to associate a statement noting that the individual believes the information is inaccurate.
